Application Process For Certificate of Good Moral

In accordance with the Vehicle Administration Act and Municipal Bylaw No. 29 of 2002 of the City of Prince Albert, those wishing to apply for a certificate of good moral character to obtain authorization to operate a taxicab in the City of Prince Albert shall;

Applicant Requirements

  1. Provide a copy of your driving abstract;
  2. Provide a copy of unexpired and valid Provincial Class 4 driver's license;
  3. A signed consent form authorizing criminal record check;
  4. A signed letter from the owner of a taxicab owner/company confirming employment of the applicant;
  5. Three letters of character reference (two must be on letterhead);
  6. Payment of an administration fee for the criminal record check and a processing fee to cover the costs of issuing the Photo Identification Card. The processing fee for the photo identification card will not be collected until the Certificate of Good Moral Character is approved. Method of payment will only include cash, certified cheque, money order. In the case of making payment by certified cheque or money order, please make payable to "City of Prince Albert".

Guidelines for Approval

If you have a criminal record, a specified period of time must elapse before the application will be approved. The period of time is calculated from the date the applicant completed serving their entire sentence, including any part in the community.

The guidelines used in determining the specified period of time described in the paragraph above are consistent with the waiting period required for a person who wishes to apply for a pardon under the Criminal Records Act and are as follows;

  1. summary conviction - 3 years;
  2. indictable conviction - 5 years;
  3. imprisonment exceeding six months - 5 years
  4. dismissal from Armed Forces - 5 years
  5. Canadian Citizens transferred to Canada under the Transfer of Offenders Act - 5 years;
  6. Absolute discharge - 1 year
  7. Conditional discharge - 3 years
  8. All other punishments - 3 years

Other Factors Considered in Not Approving Certificate of Good Moral Character

  1. If an applicant has ten (10) or more point accumulation for provincial statute driving convictions, determined from applicants driving abstract the application for good moral character will not be approved.

    1. Persons will accumulate two (2) points for every traffic ticket received.
    2. A person's point total will be reduced by one (1) point for every month that they have not received a traffic ticket in the preceding calendar year of the application date.
    3. A person initially refused a Certificate of Good Moral Character due to their driving record may re-apply when the total of their points accumulated has been reduced to six (6).
  2. The following guidelines will also be additional considerations that will effect the approving of a certificate of good moral character and cause rejection of the certificate when the applicant;

    1. is the subject of an ongoing criminal investigation;
    2. is charged with a criminal offence;
    3. is subject to an active court order;
    4. has two or more criminal driving convictions within the preceding calendar year;
    5. has a criminal record for extreme violence, murder, manslaughter, assault causing bodily harm, aggravated assault, assault with a weapon, armed robbery, criminal harassment, uttering threats, or any sex related offence, regardless of the time elapsed since the completion of sentence.

      Appeal Procedure

      Persons who have been refused their Certificate of Approval may appeal to the Chief of Police. The appeal must be in writing and state the reasons why the appeal should be allowed. The appeal must also be filed within 30 days of being notified that the Certificate of Good Moral Character was rejected.

      The applicant will be notified, in writing, of the results of their appeal. The Office of the Chief of Police or his designate will draft this notice.
